1) Acceptance of Terms
By accessing or using the Site, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.
2) Who We Are (Listing Service Only)
CDD is a local deals and listings platform. We help Charlotte-area businesses publish offers and help shoppers discover them. CDD is not the merchant of record and does not process payments for any purchase or redemption. Purchases, bookings, redemptions, refunds, exchanges, and customer service are handled directly by the business offering the deal.
3) Eligibility
The Site is intended for persons 18 years or older and for use in the United States. By using the Site, you represent you meet these requirements.
4) Privacy
Your use of the Site is also governed by our Privacy Policy (see footer link). It explains what we collect and how we use it, including our email newsletter via MailerLite and your opt-out choices.
5) Accounts & Submissions
You may browse most of the Site without creating an account.
Businesses that submit listings must provide accurate, current information and keep it updated.
If you create an account or submit content (copy, images, logos, offers, terms, codes, links), you are responsible for all activity under your account and for securing your credentials.
6) Business Listings & Offers
Accuracy & Compliance. Businesses are solely responsible for the accuracy, legality, and availability of their offers, including pricing, restrictions, taxes, and compliance with applicable laws.
Redemption Terms. Each deal page should clearly state how to redeem, any limits, valid dates, and any exclusions.
Checkout Links. If a listing includes a link-out to the business’s own checkout (Stripe, Square, Toast, etc.), the business is responsible for that checkout experience, order fulfillment, refunds, and customer support.
Removal/Edits. We may edit, refuse, or remove any listing at our discretion (e.g., outdated, misleading, unlawful, or reported content).
7) User Conduct
You agree not to:
Violate any law or third-party rights (IP, privacy, publicity).
Post or transmit content that is unlawful, deceptive, defamatory, obscene, or harmful.
Interfere with Site operations, attempt to access non-public areas, or bypass security measures.
Scrape, harvest, or use automated means without our prior written consent.
8) Your Content & License
By submitting any content to the Site (including business information, images, logos, copy, and offers), you represent you have the necessary rights to do so and you grant CDD a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute such content in connection with the Site, our social media, emails, and marketing of your listing. You can request removal of your listing at any time; removal may not affect prior distributions (e.g., emails already sent).
9) Intellectual Property
Except for content you or other third parties submit, all Site content and materials are owned by or licensed to CDD and are protected by intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works from the Site content without our prior written permission.
10) Third-Party Websites & Services
The Site may contain links to third-party websites (including businesses’ checkout pages). We are not responsible for those sites or their policies. Review their terms and privacy policies before using them.
11) Coupons, Discounts & Availability
All promotions, coupons, discounts, and redemptions are provided by the business, not CDD.
Availability may change without notice. We do not guarantee any specific price, discount, inventory, or redemption success.
No cash value unless required by law. Expiration dates and limits apply as stated in each listing.
12) No Fees from Customers to CDD
CDD does not charge customers a fee to view or use listings on the Site. If you purchase through a business’s checkout, you pay the business directly.
13) Disclaimers
To the fullest extent permitted by law:
The Site and all content are provided “as is” and “as available.”
We make no warranties of any kind (express or implied) regarding the Site, listings, or third-party services, including fitness for a particular purpose, accuracy, availability, or non-infringement.
We do not control or guarantee any third-party offers, checkout experiences, or outcomes.
14) Limitation of Liability
To the fullest extent permitted by law, CDD and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits or revenues, arising out of or related to your use of the Site, listings, or third-party services, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Site shall not exceed $100.
15) Indemnification
You agree to indemnify, defend, and hold harmless CDD from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your content or listings; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.
16) Termination
We may suspend or terminate access to the Site (or remove listings) at any time, with or without cause or notice. You may stop using the Site at any time.
17) Changes to the Terms
We may update these Terms from time to time. The Effective Date above shows the latest revision. Continued use of the Site after changes means you accept the updated Terms.
18) Governing Law & Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina for any dispute arising from these Terms or the Site.
